Terms of Service

These Terms of Service ("Terms") govern your access to and use of MOQers, a platform that lets sellers launch group-buy campaigns ("Pools") that only fund once enough buyers reserve units to clear a minimum order quantity ("MOQ"). By creating an account, launching a Pool, or reserving a unit in a Pool, you agree to these Terms.

1. What MOQers is

MOQers is a marketplace, not a manufacturer, shipper, or escrow agent. Sellers list Pools describing a product, price, and MOQ. Buyers reserve units against a Pool. If a Pool reaches its MOQ before its deadline, buyers' cards are charged and the seller is paid out, less MOQers' platform fee. If a Pool does not reach its MOQ, no buyer is charged and the Pool is dissolved.

2. Accounts

You must provide accurate information when creating an account and are responsible for activity under it. You must be at least 18 years old to launch a Pool, back a Pool, or otherwise transact on MOQers.

3. Seller obligations

• Listings must accurately describe the product, price tiers, MOQ, and estimated ship window.
• Sellers are the merchant of record for their Pools and are responsible for fulfilling funded orders.
• Sellers must have a legal right to sell the listed product and must comply with applicable customs, duty, and import regulations for their stated country of origin.
• Sellers may not use MOQers to list items that are illegal, counterfeit, or prohibited under our content policy.

4. Buyer obligations

Reserving a unit in a Pool authorizes MOQers to charge your payment method if and when the Pool funds. Reservations are not guaranteed orders until a Pool crosses its MOQ. You are responsible for providing an accurate shipping address at the time of reservation.

5. Funding, fees, and cancellation

MOQers charges sellers a platform fee, deducted from the payout, only on Pools that successfully fund. Buyers are never charged a platform fee. If a Pool does not reach its MOQ by its deadline, all authorizations are released and no fee is collected by MOQers. Current fee rates are published on our Pricing page.

6. Shipping, customs, and duties

Where a listing discloses an estimated country of origin, HTS code, or duty rate, that information is an estimate provided by the seller for buyer transparency and is not a guarantee of final landed cost, customs treatment, or delivery timeline. Actual duties, taxes, or import fees may differ and, unless a listing states otherwise, are the responsibility of the party acting as importer of record for that shipment.

7. Prohibited conduct

• Manipulating reservation counts, using fake accounts, or otherwise misrepresenting demand for a Pool.
• Circumventing MOQers' fees by arranging payment outside the platform for a listed Pool.
• Uploading content you don't have rights to, or that infringes another party's intellectual property.
• Interfering with the platform's operation, security, or other users' ability to use it.

8. Disclaimers and limitation of liability

MOQers is provided "as is." We do not guarantee that any Pool will fund, that a seller will fulfill an order, or that any product will meet a buyer's expectations. To the fullest extent permitted by law, MOQers is not liable for indirect, incidental, or consequential damages arising from your use of the platform, including disputes between buyers and sellers.

9. Suspension and termination

We may suspend or terminate accounts that violate these Terms, engage in fraud, or pose a risk to other users. Sellers who are suspended may not launch new Pools; existing funded obligations are handled on a case-by-case basis.

10. Changes to these Terms

We may update these Terms from time to time. Continued use of MOQers after an update constitutes acceptance of the revised Terms.
